1. SCOPE OF APPLICATION

1.1 These general conditions of sale (GTC) apply to all contracts for the purchase of goods that you conclude with us, AWAHENA, via our online store.
1.2 The conditions that you have pre-established, which differ from these GTC, do not form an integral part of the contract, even knowingly, unless we expressly accept their validity and subject to compliance with the written form (e.g. e.g. by email).
1.3 The General Terms and Conditions only apply if you are a consumer, that is to say if the purpose of the products and services ordered cannot be mainly attributed to your commercial or independent professional activity.
1.4 A sale to customers who act in the exercise of a commercial or independent professional activity and therefore as entrepreneurs or a sale of non-routine quantities must be notified to us separately in advance.

2. CONCLUSION OF THE CONTRACT

2.1 Our information on products and prices in the context of each order process is for information purposes only and without obligation.
2.2 You can put the products in the virtual basket without obligation. After clicking on the “Continue order” button, you can enter delivery and billing data and select the desired payment method. You may correct the information you have entered at any time before submitting your binding order by using the correction tools provided in the order process. By clicking on the “Buy now” button, you place a binding order for the products in your basket. Confirmation of receipt of your order will be sent to you by email immediately after your order is sent.
2.3 The time at which the contract between us is concluded depends on the payment method you have chosen:

  • Amazon Pay
    During the ordering process, you will be redirected to the website of the online provider Amazon before the ordering process in our online store is completed. There you can select the shipping address and payment method registered on Amazon and confirm the payment order to Amazon. Then you can complete the ordering process as usual in our online store. After placing your order, we ask Amazon to initiate the payment transaction and thus accept your offer.
  • Credit card
    When placing the order, you also provide us with your credit card details. After you have been legitimized as the legitimate cardholder, we ask your credit card company to initiate the payment transaction and thus accept your offer.
  • Paypal
    After the order process, you will be redirected to the website of the online provider PayPal. There you can validate your PayPal payment order. By issuing the payment transaction request to Paypal, we accept your offer.

2.4. We do not save the contractual text.

3. PRICES AND PAYMENT METHODS

3.1 All prices are exclusive of tax and are sometimes subject to flat rate shipping charges.
3.2 The following payment methods are generally available for deliveries:

    • Paypal

3.3 Unless otherwise stated for the different payment methods, claims arising from the concluded contract are immediately due and payable.

4. DELIVERY AND SHIPPING CONDITIONS

4.1 The products will be shipped to the delivery address you provide.
4.2 Delivery times and restrictions (e.g. limitation of deliveries to certain countries) for the individual products will be communicated to you on a separate information page “ Shipping costs and delivery times » or as part of the description of the product concerned.
4.3 Any customs duties or local taxes are your responsibility.

5. RESERVATION OF OWNERSHIP

The product delivered to you remains our property until full payment of the price.

6. NO SALES TO INDUSTRIAL CONSUMERS

6.1 The goods offered in the store are only sold to end consumers. Commercial resale of the products is not permitted without our express permission.
6.2 We have the right to terminate the sales contract if a customer purchases products from us in violation of the prohibition mentioned in paragraph 1 in order to resell them, or if he has already resold the products.

7. WARRANTY

7.1 In the event of defects in the delivered purchase item, you are entitled to legal rights within the framework of the guarantee/liability for defects detached from any guarantee.

10. FINAL PROVISIONS, CHOICE OF APPLICABLE LAW

10.1 Irish law applies, excluding the provisions of the United Nations Convention on Contracts for the International Sale of Goods. With regard to consumers, this choice of law only applies if the protection granted is not withdrawn by mandatory provisions of the law of the State in which the consumer is normally domiciled.
10.2 If certain provisions become obsolete or inapplicable in whole or in part, or if they subsequently lose their legal validity or applicability, the validity of the other provisions will not be affected. The legal regulations apply to replace obsolete or inapplicable provisions.
